Code Description:
Permits are required to be obtained from the City for all site construction projects and/or land disturbances as set out in the City of Bowling Green Stormwater Best Management Practices (BMP) Manual. The developer shall also coordinate with the KYDOW and the U.S. Army Corps of Engineers to determine whether permits are required from those agencies before construction begins. Each developer shall submit an application to the City on a form provided by the City. A large area of fill / construction spoil has been built up, possibly in the floodplain of Drakes Creek. The area exceeds 750 square feet and alters drainage characteristics of the lot. This has been done without the required permit.
Corrective Action Required:
1. A Site Work permit application must be submitted for review no later than Friday, 27 February 2026. This must address both local compliance issues and the floodplain of Drakes Creek.
2. All site work other than required Erosion Prevention and Sediment Control actions to abate other violations on this NOV must cease until the Site Work Permit is approved.
3. If the Site Work permit has not been approved within two weeks of receipt of this notice, then all areas of bare soil must receive temporary stabilization.
Failure to meet the timelines above will result in additional citations and fines.

Code Description:
Requirements for the design, maintenance, and a menu of Best Management Practices (BMPs) are located in the City of Bowling Green Stormwater BMP Manual. Site construction in the City shall comply with the provisions of the BMP Manual. A large area of fill / construction spoil has been built up, possibly in the floodplain of Drakes Creek. The area exceeds 750 square feet, and as such requires the implementation of EPSC BMPs, a site work permit with engineered plot plan, and oversight by an EPSC-certified contractor.
Corrective Action Required: Erosion Prevention and Sediment Control BMPs compliant with the City's BMP manual must be installed by Wednesday, 25 February 2026. At a minimum, this includes a stabilized construction entrance and perimeter silt controls. If they have not been installed at that time, a second citation will be issued.
