Code Description:
Any occupied structure condemned and placarded by the code official shall be vacated as ordered by the code official. Any person who shall occupy a placarded premises or shall operate placarded equipment, and any owner or any person responsible for the premises who shall let anyone occupy a placarded premises or operate placarded equipment shall be liable for the penalties provided by this code.

Code Description:
The code official shall have the authority to authorize disconnection of utility service to the building, structure or system regulated by this code and the referenced codes and standards set forth in Section 102.7 in case of emergency where necessary to eliminate an immediate hazard to life or property or when such utility connection has been made without approval. The code official shall notify the serving utility and, whenever possible, the owner and occupant of the building, structure or service system of the decision to disconnect prior to taking such action. If not notified prior to disconnection the owner or occupant of the building structure or service system shall be notified in writing as soon as practical thereafter. The electrical hazards inside the dwelling, coupled with the use of space heaters surrounded by combustible materials, improper wiring, broken receptacles, exposed wiring, etc. lead to an immediate dangerous situation within the structure and require utilities be disconnected for the safety of occupants and the surrounding public.

Code Description:
Unsafe equipment includes any boiler, heating equipment, elevator, moving stairway, electrical wiring or device, flammable liquid containers or other equipment on the premises or within the structure which is in such disrepair or condition that such equipment is a hazard to life, health, property or safety of the public or occupants of the premises or structure. Homeless and vagrant individuals are using multiple space heaters throughout the building, posing an immediate danger in rooms piled full of combustible material, with no fire safety mechanisms in place, and multiple areas of unsafe electrical wiring, electrical appliances, and improper wiring.

Multiple homeless and vagrant individuals have been occupying this residence due to the property owner's failure to properly secure the residence from entry for several months. Due to multiple doors and windows being boarded from the outside, and numerous subjects inside on an ongoing basis, coupled with hazardous electrical wiring and space heaters, occupants could not have safely escaped in event of a fire.

All exterior property and premises shall be maintained in a clean, safe and sanitary condition. The occupant shall keep that part of the exterior property which such occupant occupies or controls in a clean and sanitary condition. The property is not maintained in sanitary condition. The interior of the property has accumulated human and animal urine and feces throughout. The exterior has accumulated trash, rubbish, garbage, etc.

All interior surfaces, including windows and doors, shall be maintained in good, clean and sanitary condition. Peeling, chipping, flaking or abraded paint shall be repaired, removed or covered. Cracked or loose plaster, decayed wood and other defective surface conditions shall be corrected. There are no plumbing utilities functioning in the house. The house has been occupied by homeless/vagrants multiple times and there is human feces and urine, and animal feces and urine throughout the house. There is graffiti throughout walls and doors of most, if not all, rooms in the house. Walls have holes, doors are broken, and the house has been ransacked multiple times.

The house has been occupied by homeless/vagrants multiple times and there is human feces and urine, and animal feces and urine throughout the house.

An unsafe / problem structure is defined as a building or other structure that poses a nuisance or danger to the public, police department or fire department and includes, but is not limited to the definition in the International Property Maintenance Code, as well as the following: A building that has become or is so dilapidated, decayed, unsafe, unsanitary or which so utterly fails to provide the amenities essential to decent living that it is unfit for human habitation or is likely to cause sickness or disease or injury to health, safety or general welfare of those living therein; C27.5.02.a.b Compliance Time Period When an unsafe / problem structure, not in danger of structural collapse, has been closed and secured from entry and the elements by the property owner and the structure continues to remain closed and secured from entry and the elements by approved methods, it may remain standing in a safe condition for a period not to exceed sixty (60) days from the date of the condemnation, fire, or damage from other means, or the date of the release of the property from a governmental, criminal, fire or explosives investigation, at which time an application must have been made for a building permit to repair or for a demolition permit. If a building permit is requested and approved, repair or renovation work to bring the property into compliance must be completed within sixty (60) days of the date of the issuance of the permit. If a demolition permit is requested and approved, demolition must be initiated within five (5) days and must be completed within thirty (30) days of the date of the issuance of the demolition permit. C27.5.02.a.c Failure to Comply Failure of the property owner to obtain the required permit(s) in the specified time and/or to keep the structure closed and secured from entry shall constitute permission to an official, employee, or other authorized agent of the City to enter upon the property to remedy the situation and to abate the nuisance by demolition and removal of the unsafe / problem structure. The dwelling at this location has no way to alert occupants of fire, has no clear and unobstructed path to escape in a fire, has been occupied by homeless/vagrants on an ongoing basis for months, is characterized by hoarding conditions, human and animal feces, human and animal urine, no plumbing utilities, no handrail on the stairs, stairs that are unsafe, multiple broken and boarded windows, electrical hazards throughout, and is not safe for human habitation or occupation.

Code Description:
It shall be unlawful to place, leave, deposit or keep discarded and/or dilapidated items or objects, trash, garbage, junk and/or rubbish on any private property in the City. Such discarded and/or dilapidated items or objects, trash, garbage, junk and/or rubbish are declared to be a public nuisance. No person owning, leasing, occupying or having charge of any property or premises shall maintain or keep any nuisance thereon, nor shall any such person keep or maintain such property or premises in a manner which could cause a substantial reduction in the value of the other property in the area in which such property or premises are located. The vacant building at this location has been broken into multiple times on numerous occasions for many months. It is continually occupied by homeless and vagrant individuals, has lead to ongoing responses by the police, codes and fire departments, has been a drain on city resources, is unsafe for occupation or habitation, and is unsanitary, dangerous, and not maintained in good condition as to not be a blight on the surrounding area.

Code Description:
All exterior property and premises shall be free from any accumulation of combustible and noncombustible waste materials, including any material resulting from maintenance, demolition, repair, alteration or construction of buildings, structures or grounds. Exterior property and premises shall be free from landscaping debris or natural damage of grounds, including but not limited to ashes, stones, glass, concrete, unused piles or bags of rock/mulch/soil, fallen trees, tree branches, limbs, brush and yard trimmings; There is an accumulation of construction/demolition and/or landscape debris on the premises. Please remove any and all construction/demolition/landscape debris.

Nuisance

Code Description:
The allowing of any physical condition, use or occupancy of any property or premises to be an attractive nuisance to children, or for illicit purposes, crime, drugs and/or vagrancy, including, but not limited to abandoned buildings, vacant lots, wells, shafts, standing pools of water, sinkholes, basements, excavations, retaining walls, and unsafe fences. Refrigerators, freezers, ice chests, ice boxes or any similar airtight box or container at an outdoor location which has a locking device inoperable from within, shall first unhinge and remove the door or lid and detach the locking device from the door or lid. Refrigerators, freezers, ice chests, or ice boxes in use at an outdoor location shall be equipped with an exterior locking device to prevent unintended access; The dwelling at this location has been broken into multiple times over the period of several months. Numerous arrests have occurred at the property. The property has required police and fire responses for several months. The property has become a constant harbor for vagrants, homeless, and nuisance activity, and has been a continual drain on city resources, a blight on the neighborhood, and a life/safety hazard for surrounding residents.
